As reported here, employees commencing employment from Good Friday 2012 will no longer have sufficient qualifying service to present an unfair dismissal complaint to an Employment Tribunal after one year. They will have to wait for two years to be able to claim Unfair Dismissal.

Employers should remember that although employees need 2 years’ service to claim unfair dismissal in most cases, there are some exceptions to this (certain types of H&S dismissals, protected disclosures, dismissals for asserting a statutory right etc.). It also remains the case that no qualifying service is required to present a complaint in relation to unlawful discrimination relating to a protected characteristic e.g. race, sex, disability etc.
