Here Mrs Brain had come up with the time honoured excuse ( at least it’s one I have heard frequently) that a Solicitor had informally advised her over the phone that she should concentrate on her internal appeal. She took this informal advice which culminated in the internal appeal being concluded outside the three month limitation period and her claim going in late. The EAT’s conclusion that it was reasonably practicable to present the claim within 3 months cannot be faulted.
