The dismissed former Director of Children’s Services at Haringey Council goes to the High Court today to seek a judicial review into the decision to dismiss her following the Baby P scandal. She was dismissed following pressure by Ed Balls, Children’s Secretary, but she contends that he was influenced by the media campaign against her. She further contends she was not given an opportunity to respond or correct the criticisms of her.
She is able to take a step in seeking a judicial review through the High Court that many employees will not have the right to do and this is because she worked for an arm of state . My experience is these such cases do not come cheaply and often at further public expense. Other employees would only have the right, subject to service, to bring an unfair dismisal case in the Employment Tribunal. What are you thoughts on whether the right decision was made?
