If you have legal expenses insurance then this is the best form of funding for your claim as you get to keep 100% of your damages from the Tribunal and get legal assistance.  We have seen insurers use all tactics to try and retain the claim by their panel solicitors and lots of complaints from employees on how these claims have been handled.  Remember once a claim is issued you have the right to chose a solicitor of your choice unless the wording of the policy prevents you from doing so which is probably against the Regulations in any event.
