It has been reported that Melinda Bodnar, a teacher at a private nursery school, is suing her former employers for sacking her by email in March this year.
Ms Bodnar had been diagnosed with cancer in November 2008 and at the time of being dismissed she had spent seven months receiving chemotherapy. The school claim that she had resigned prior to being diagnosed.
Ms Bodnar has presented a claim to the Tribunal, which is expected to be heard later this year. Of course if it is found that Ms Bodnar was dismissed due to her illness, which is a disability within the definition of statute, then the school may be found to have discriminated against her and her dismissal may be held to have been unfair.
